Key DENR Regulations for Boracay Property Owners

Beachfront Setback — 25 Metres

Critical

No permanent structure may be constructed within 25 metres of the high-water mark on Boracay. This applies to all of White Beach and Boracay's other beaches. Illegal structures built before 2018 within this zone were subject to demolition and many were removed. Buyers must verify that any property's structures comply with this setback before purchase.

Environmental Compliance Certificate (ECC)

Any new construction project on Boracay — including renovation projects above a certain threshold — must obtain an Environmental Compliance Certificate from DENR. This process involves environmental impact assessment, public consultation, and DENR review. Projects begun without ECC face stop-work orders and demolition.

Easement and Right-of-Way

A mandatory 3-metre easement from the edge of the beach (not the high-water mark) is required to remain open to public passage under the Water Code. Structures encroaching on this easement were a primary target of the 2018 demolition orders.

Sewage and Wastewater Standards

All properties must connect to the centralised sewage system installed during the rehabilitation. Discharge of untreated wastewater into the ground or sea is prohibited and subject to immediate enforcement action.

Solid Waste Management

Properties must comply with the island's solid waste management regulations including segregated waste collection, prohibited burning, and participation in the centralised waste management system.

Building Height Restrictions

Building height limits apply across different zones of the island. Generally, structures in beachfront and near-beach zones are limited to 4 storeys. Mid-island commercial zones allow taller structures with additional approvals.
